Required addiction warning

Under U.S. Food and Drug Administration (FDA) regulations applicable to covered tobacco products (including many e-cigarette and nicotine vapor products), manufacturers and retailers must display the nicotine addiction warning statement on advertising and packaging as required by law.

The SPOT displays this warning on the age gate, site header strip, product pages, cart, and footer. Warning language, size and format requirements, and product classifications are maintained according to current FDA requirements.

No unauthorized modified risk claims

The SPOT does not claim that vaping is safe, safer, healthy, or an FDA-approved cessation method unless and until such claims are expressly authorized by the FDA for the specific product. Do not add comparative risk marketing without legal review.

Premarket review

Many vapor products require FDA premarket authorization (e.g., PMTA) to be legally marketed in the United States. Selling unauthorized products can expose the merchant to enforcement. Inventory selection is the merchant's responsibility.

Audience

Products offered through The SPOT are intended only for adult smokers and adult vapers who are 21 years of age or older.
